Despite your late-night Google searches, you're still unclear how it's all going to work out. Who pays the real estate agent? This is a very common question.

To fully understand who pays real estate commissions — whether it's the sellers, buyers, or both — you first must take a look at how real estate agents are getting paid and how they share cooperating commissions.

How Real Estate Commissions Work

Real estate commission fees are how most real estate agents are paid for the homes they sell.

These agents work for a real estate broker, so all fees paid to the real estate agent pass through this broker. Only a real estate broker can pay the real estate commission and sign a listing agreement with a seller.

On average, buyer's agents are paid around 2.65% of the final sale price of a home. The seller is usually responsible for paying this fee.

Realtor commission changes may be coming 

A November 2023 lawsuit found the National Association of Realtors (NAR), Homeservices of America, and Keller Williams Realty guilty of misleading sellers into paying inflated realtor commissions.

Traditionally, the seller pays the entire 5-6% commission, which is then split between the seller's and buyer's agent. The lawsuit argued that this system burdens sellers with the cost of paying the buyer's agent, who may not represent their best interests.

However, the ruling indicates a potential shift in this practice and suggests that buyers might soon be the ones paying their agents' commissions. 

While immediate changes to realtor commissions are not expected, we will keep an eye on developments and update our content as needed.

Is it the Buyer Who Pays?

If you're buying a home, you're probably off the hook for paying the real estate agent commission. The home seller covers the commission fee for both the seller's and the buyer's agent. However, that doesn't mean that there is no cost to the buyer. Sellers sometimes account the fee they'll be paying by including them in their listing price.

The seller then is not obligated to compensate the listing broker for more than the listing side or portion of the commission. Reduced listing prices often reflect the amount the buyer is paying. Sellers can also credit the buyer the commission and the buyer, in turn, credits the brokerage.

Is it the Seller Who Pays?

When the sellers set the listing price for the home, they usually take the agent's commission into account. It's just the cost of doing business. Under a Buyer's Broker agreement, the named brokerage and agent represent the buyer. The seller most commonly pays the fee paid to the broker. Some Buyer Broker agreements contain clauses that will compensate the brokerage for the fee if it is less than the amount paid by the seller.

The home seller usually picks up this tab. Typically, the seller pays the fee at the settlement table at the time of sale, where the total is subtracted from the proceeds of the home sale.

Who is Really Paying?

You can argue the buyer always pays the commission. Why? Because it's part of the sale price. If the seller did not sign an agreement to pay the commission, the sale price might decline.

Whether you're a buyer or a seller, the listing price is not the only number you should consider. Fees outside the cost of the house can add up, and you don't want to be hit with surprises later in the game. If the closing costs are a little bit steep, and the seller won't chip in as much as the buyer would like, the buyer can request to roll the closing costs into the mortgage.

It can take anywhere from five to 10 days to secure a mortgage pre-approval. A straightforward application may be approved in three to five days, while a more complicated situation could take two weeks or longer.

How long it takes to get a mortgage pre-approval depends on how fast you and your lender can gather and evaluate your financial documents. Approval is based on your gross monthly income, debt payments, assets, credit reports, and employment history.

Getting a mortgage pre-approval letter provides you with a home buying budget and shows sellers you’re serious about buying.

How long does a mortgage pre-approval last?

A mortgage pre-approval is usually good for 90 days, though some lenders can issue them for 30 to 60 days. The expiration date will be in your pre-approval letter, along with other terms and conditions, like how much you’re approved to borrow and your interest rate.

Mortgage pre-approvals expire because your financial situation can change within the approval window. For example:

  • You could open a new credit card, which could lead to a lower credit score.
  • Your job or level of debt compared to income could change.
  • Mortgage rates might have fluctuated, so the rate you were quoted initially could affect your final approved amount.

Maintain communication with your lender. If your mortgage pre-approval expires before you make an offer on a house, you’ll need to apply again. And you might need to provide updated documents or resubmit the necessary paperwork.

Other information to have handy

Estimated price of the property. You’ll want to know an estimate of how much you can afford. Be sure to ask your lender what the minimum down payment required is.

Type and purpose of the property — i.e., whether this will be your primary residence, a secondary home, or an investment property. Lenders will have different rates and requirements for different property types.

Your debt level. A lender will check that your debt (mortgage payment, car or student loans, etc) makes up no more than 36% of your total pre-tax income.

2. Choose a mortgage lender that's fast

Lenders that can easily upload documents, accept e-signatures, and other technology to cut down on time may be faster. They may also be able to improve their customer service and be more readily accessible for support throughout the process.

Ask mortgage lenders directly about how long it takes for them to grant pre-approval.

If you're trying to find a good lender online, check reviews and ratings from past customers on Google, Facebook, Better Business Bureau. Good lenders should have visible proof (such as a decent amount of positive ratings). Look specifically for comments about speed and customer service.

You also agree and consent to being contact by Clever's real estate professionals either by e-mail, telephone, mail or any other reasonable means of communication, including autodialed phone calls, text messages, and prerecorded messages from Clever and its partners, on any landline or cell phone number provided to Clever, even if such number is on a Do Not Call list and even if charges are incurred for the call or text. You understand that consent to receiving such communications is not a condition of receiving Clever's services and that you can call 1-833-2-CLEVER for services should you choose not to receive such communications.

You are obligated to provide information that is accurate and complete so that Clever can provide you with a real estate agent that is suited for the potential transaction and Clever reserves to the right to terminate anyone who provides false, inaccurate or misleading information.

Payment of any Cash Back, rebate, or incentive for use of the Clever platform is contingent upon Clever's receipt of a Service Fee related to the same use of its platform. If Clever fails to collect a Service Fee, it shall have no obligation to pay any Cash Back, rebate, or similar incentive. In the event Clever collects a Service Fee that is less than the money owed under any Cash Back, rebate, or other similar incentive program, Clever shall have the right to reduce the Cash Back, rebate, or incentive to an amount equal to or less than its Service Fee

CLEVER IS MERELY A REFERRAL SERVICE. All terms and conditions between a home seller or buyer and a real estate professional is governed by a separate legal agreement that does not involve Clever and is solely between the home owners or buyers and the real estate professional.

Referrals provided by Clever via this website are not recommendations by Clever for any particular service provider referred and should not be considered as such. You are responsible for vetting referrals and choosing the service provider(s) which best suits your individual needs.

Even though your participation in this referral service may be terminated by you or Clever at any time with written notice and it totally voluntary, any referrals that Clever may have with a real estate professional prior to termination are still effective.

Arbitration

You further acknowledge and agree that Semya-Moya shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

Communications

By submitting a form to Clever you consent to have Clever or one of its partners to contact you via autodialed phone calls and text messages, and prerecorded messages, on the landline or cell number provided even if your on any Do Not Call list and even if you are charged for the call or text. If you’re a buyer who’s lost bidding wars on multiple homes, or can’t find what you’re looking for, you might be tempted to just throw in the towel. But don’t give up on your dream of home-ownership just yet! Instead, learn how to buy a house that's not for sale.

How to Find Off-Market Properties

An off-market home is one that isn’t listed on the MLS or isn’t for-sale-by-owner. You can find them by driving through your desired neighborhood and identifying homes that look like a good fit for you.

1. Search online

Websites like Zillow and Trulia let you set up property alerts. Zillow has a "Make Me Move" feature where owners list their dream price for a property. Your off-market dream home could be on that list, which at least tells you that the owner has some interest in selling.

2. Hire an agent

Don’t think that an agent can help you find a home that isn’t already for sale? Think again! Agents are often aware of upcoming listings in their brokerage or in the neighborhoods they serve. Armed with your criteria, they can network with other agents to jump on a listing before it’s actually on the market and avoid a bidding war.

3. Download real estate software

If you're looking for a great deal, downloading a real estate app can help you find cheap off-market properties and reach out to owners instantly.

Popular real estate software or websites for investors include:

  • DealMachine: The DealMachine app helps you find and research distressed homes and get in touch with motivated owners fast to see if they're interested in selling.

    When you're driving around town and spot a home that looks like it could be a great deal, you pull up the home on your DealMachine app, where you can send the owner direct mail (no post office visits required).   • Zillow foreclosure center: Zillow makes it easy to find foreclosed and bank-owned properties in your area. However, unlike off-market properties you'd find on DealMachine and other software, most of Zillow's properties are publicly listed - meaning you'll likely face stiff competition from other investors.

Researching an Off-Market Property

Buying a house that isn’t for sale requires more work than simply searching the MLS, attending an open house, and making an offer.

In the best case scenario, the property was previously on the market, and the owner withdrew the listing. This means that they once had an interest in selling, so you have a better chance of convincing them to sell now. What you need to find out, if possible, is why they took the house off the market.

The owners could have pulled the listing because they didn’t receive the offers they wanted, they could have been unhappy with listing agent or their commissions, or their life circumstances changed. Addressing those reasons in your offer improves your chances of it being accepted.

A vacant property presents more of a challenge. If the owner died intestate (without a will) the house could be in probate, the city might have condemned the property, or it could be in litigation or foreclosure. You’re going to have to do some digging.

Search online county records to find the last owner and see if you can track them down. Googling their name plus obituary will tell you if they’ve passed away but also possibly lead you to any heirs. Look up the property on zillow.com to see if it’s in pre-foreclosure.

If your research isn’t getting you anywhere, or you don’t have the time, consider finding a buyer’s agent who has great negotiating and research skills to help you in your quest. Making an Offer on a House That's Not for Sale

Armed with the information on why the house isn’t currently for sale, prepare an offer letter tailored to the owner’s situation.

Be flexible and work with the owners on a possible move-in date, or offer to let them rent from you while they find a new house. And get pre-approved for the mortgage before making the offer. You want to make it as easy and attractive as possible to them to sell their house.
